1. Agreement to Terms
Acceptance
By downloading, installing, or using FamilyCart ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Binding Agreement
These Terms constitute a legally binding agreement between you and Optiwise ("Company," "we," "us," or "our") regarding your use of the FamilyCart mobile application.
2. Description of Service
What FamilyCart Offers
FamilyCart is a collaborative grocery shopping application that allows users to: create and share shopping lists with family members and groups, sync lists in real-time across devices, organize items by store, save favorite items, and coordinate shopping activities without requiring account creation.
Free Service
FamilyCart is provided free of charge. There are no premium tiers, subscriptions, or in-app purchases required to access any features.
3. Eligibility
Age Requirements
FamilyCart is designed for family use. Children may use the App under parental supervision. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
4. User Content
Your Content
You retain ownership of any content you submit through the App, including shopping lists, item names, and group names.
License Grant
By submitting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the service.
Shared Content
When you share lists with a group, other group members can view, edit, and delete items. You are responsible for only sharing lists with people you trust.
Content Standards
You agree not to submit content that: is illegal, harmful, or offensive; infringes on any third party's rights; contains malware or harmful code; or violates any applicable laws or regulations.
5. Intellectual Property
Our Property
The App, including its design, features, content, and underlying technology, is owned by Optiwise and is protected by copyright, trademark, and other intellectual property laws.
Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
6. Disclaimers
"As Is" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Warranty
We do not warrant that: the App will be uninterrupted, error-free, or secure; any defects will be corrected; or the App or servers are free of viruses or harmful components.
Data Sync
While we strive for reliable synchronization, we do not guarantee that all data will sync in real-time or that no data loss will occur. We recommend not relying solely on FamilyCart for critical information.
7. Limitation of Liability
Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OPTIWISE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
Liability Cap
Since FamilyCart is a free service, our total liability to you for all claims arising from or related to the App shall not exceed one hundred dollars ($100).
8. Termination
By You
You may stop using the App at any time by uninstalling it from your devices.
By Us
We may suspend or terminate your access to the App at any time if we believe you are violating these Terms or using the App in a way that could harm other users or our infrastructure.
9. Changes to Terms
Right to Modify
We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date and, for significant changes, through an in-app notification. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
10. Governing Law
Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
